You can also apply for the EU Settlement Scheme if you are a direct family member or are married to a European citizen with an EUSS residence permit, as long as the marriage was before December 31, 2020.
With EU Settlement Scheme approval you will have one of two residency permits: Pre-Settled Status, or Settled Status.
Pre-Settled Status is a temporary residence permit that allows you to study, work and live in any country in the UK for 5 years. You are allowed to stay outside the UK for up to 6 months in any 12 month period, for a maximum of 2 years in the 5 year Pre-Settled Status period. Upon completing 5 years of continuous residency and having all the necessary requirements, you can move to Settled Status.
Settled Status is a permanent residence permit that allows you to study, work and live in any country in the UK for as long as you wish, you receive it when you have 5 years of continuous legal residence in the UK. In addition, you are allowed to stay away for up to 5 consecutive years without losing your status and, if you are eligible, you will be able to apply for British citizenship after one year and obtain all the rights of a British citizen.
How to apply for the EU Settlement Scheme?
For direct family members, it will first be necessary to apply and be approved for the EU Settlement Scheme Family Permit, and then when you arrive in the UK, you will have a period of 3 months to apply for the EU Settlement Scheme.
Therefore, before applying, regardless of whether you are a family member or a citizen of the European Union, you must provide all the necessary documents, translate those in Portuguese into English and then digitize them all. Once your identity is verified you will be directed to the official website of the British Government, where your registration will continue. On this site, you will apply online, fill in your personal details and answer an online questionnaire in English.
As a family member, you will apply directly on the official website of the British Government, where you will also fill in your personal data and that of your family member and then answer a questionnaire in English.
At the end of the questionnaires, there will be a space to enter your documents and scanned evidence that proves that your request is legitimate.
If your online application as a citizen of the European union is successful you will receive an email confirming the application or, in some cases, you may be asked for further documents as evidence.
In the case of application by family members, when completing the online application, a link to a private company will appear, where you will schedule to take your biometrics and a photo as a procedure to confirm your identity. After biometrics, you will receive an email saying if you were approved or not.
